Another successful NJ DWI defense

I recently represented a client who (like many) experienced a New Jersey DWI charge as his first ever brush with the law. Sadly, his DWI offense was compounded by the fact that he was also involved in a car accident.

Fortunately, there were no personal injuries and only property damage. However, the Flemington NJ police charged him with DWI, Careless Driving, Leaving the Scene of an Accident, and Failure to Report an Accident. It is very common in a NJ DWI case for the police to “tack on” every conceivable violation/ticket. I was retained shortly after the charge, and was able to successfully argue to have the prosecutor agree to exclude the Breathlyzer reading of .12 from state’s evidence due to the police having placed their walkie-talkies too near the breathalyzer machine (which can interfere with the electronics), as well as a gap in the observation period of my client prior to his blowing into the Breathalyzer.

I was also able to negotiate a dismissal of all other charges. My client lost his license for the minimum time period of 90 days and paid the minimum in fines.
